About these terms
1.1.UgathSell is run by an independent operator. These terms, together with the Marketplace rules and the Privacy Policy, apply when you create an account or use the site. By using UgathSell, you agree to them.
1.2.If you do not agree with them, please do not use UgathSell.
Using UgathSell
2.1.UgathSell is intended for people aged 18 and over.
2.2.It is designed for university students in Malaysia buying and selling their own belongings, and is intended for personal rather than commercial use.
2.3.Each person may hold one account, and the details you provide, including your university and campus, should be accurate and kept up to date.
2.4.Please keep your login details secure. You are responsible for activity that takes place on your account.
Our role
UgathSell provides a place for members to list items and get in touch with one another. We:
a)do not own, inspect or sell the items listed;
b)do not process payments or hold deposits, and do not offer refunds, escrow or guarantees;
c)are not a party to arrangements made between buyers and sellers;
d)do not verify members' identities. University and campus details are provided by members themselves.
Arrangements are made directly between members, who are responsible for resolving any issues between them and for complying with applicable laws. We encourage you to meet in a public place and to see an item before paying for it.
Your content
4.1.You keep ownership of the listings, photos and messages you post.
4.2.You allow us to store, display and adapt them, for example by resizing photos, as needed to operate UgathSell while they remain on the site. This permission is free of charge and non-exclusive.
4.3.By posting, you confirm that you have the right to do so, including the right to sell the item and to share its photos.
4.4.Listings, profiles and photos are visible to the public. Messages are private between the members involved, except as described in the Privacy Policy.
Acceptable use
Alongside the Marketplace rules, we ask that you do not:
a)mislead, pressure or harass other members;
b)present yourself as someone else, including as a member of the UgathSell team;
c)post repetitive or unrelated content;
d)gather other members' information in bulk or use it outside UgathSell;
e)interfere with the site or access accounts or information that are not yours.
Moderation
6.1.To keep UgathSell safe, we may remove content or restrict, suspend or close accounts where we believe these terms or the Marketplace rules have not been followed, or where others may be at risk. Where appropriate, we will let you know the reason, and you can ask for a review as the Marketplace rules describe.
6.2.We do not review all content before it appears on the site.
Closing your account
7.1.You can close your account at any time from your profile. The Privacy Policy explains what happens to your information when you do.
7.2.We may change or discontinue parts of UgathSell from time to time, and will aim to give reasonable notice where we can.
Fees
8.1.UgathSell is currently free to use. If we introduce paid features in future, we will let you know beforehand and publish the terms that apply to them, including any refund terms.
Disclaimer
9.1.UgathSell is provided on an "as is" and "as available" basis. While we work to keep it running smoothly, we cannot guarantee that it will always be available or free of errors, or that listings and member information are complete and accurate.
Limitation of liability
10.1.To the extent permitted by law, we are not liable for losses arising from arrangements, items or meetings between members, from content posted by members, or from the site being unavailable. Where we are found liable, our total liability to you will not exceed RM100.
10.2.Nothing in these terms affects rights you have under Malaysian law that cannot be excluded, including under the Consumer Protection Act 1999.
Changes to these terms
11.1.We may update these terms from time to time, and the date at the top of this page shows when they last changed. Where a change is significant, we will let you know on the site before it takes effect. Continuing to use UgathSell after that means you accept the updated terms.
Governing law and contact
12.1.These terms are governed by the laws of Malaysia, and any dispute relating to them will be handled by the courts of Malaysia.
